In Odessa, a judge refused to recuse a colleague in a high-profile case involving the death of a patient at the Odrex clinic
On Friday, September 18, the defense attorneys for Vitaliy Rusakov, a doctor at the Odrex clinic in Odessa, filed a motion to recuse Judge Viktor Chaplitsky due to doubts about his impartiality. The judge denied the motion.
The grounds for Chaplytsky’s recusal were allegedly the existing ties between Serhiy Chvankin, the head of the Kyiv Court in Odesa, and the family of real estate developer Adnan Kivan, whose death the doctors at the Odrex clinic are accused of causing.
However, Judge Hennadiy Voitov of the same court denied the recusal request. Therefore, Chaplytskyi will continue to preside over this high-profile case, according to the Anti-Corruption Action Center.
As a reminder, prosecutors from the Office of the Prosecutor General have charged Odrex doctors Vitaliy Rusakov and Mariya Bilotserkivska with professional negligence, which, according to the prosecution, led to the death of Odesa-based developer owner of KADORR Group and the Kyiv Post, Adnan Kivan.
As a reminder, the widow of one of the patients at the Odessa-based private clinic Odrex, who died following treatment, is seeking the establishment of a clinical expert commission to investigate the doctors’ actions. The woman discovered discrepancies in the medical records, but her request for an investigation was denied.
A case has been ongoing in Odesa for over eight months regarding the circumstances surrounding the death of multimillionaire and investor Adnan Kivan and possible medical malpractice during his treatment. The founder of the KADORR Group died on October 27, 2024. A few months prior, starting in June 2024, he had been treated at the private Odrex clinic.
In August 2026, the Kyiv District Court of Odesa, presided over by Judge Viktor Chaplytskyi, continued to examine the evidence in the case against the doctors.
