The Verkhovna Rada approved the dismissal of a judge from Chernivtsi following a complaint by patrol officers

The First Disciplinary Chamber of the High Council of Justice has adopted a decision to submit a motion for the dismissal of Andriy Triska, a judge of the Sadhirsky District Court of Chernivtsi. Pending a final decision by the High Council of Justice, he has been temporarily suspended from judicial duties.

As noted by the High Council of Justice, the decision to impose a disciplinary sanction in the form of a motion for dismissal automatically entails the judge’s temporary suspension from his duties until the High Council of Justice has finalized its consideration of the matter.

The disciplinary proceedings were initiated based on a complaint filed by patrol police officers. According to their account, a report was filed against the judge for driving under the influence. The court found him guilty, imposed a fine, and revoked his driver’s license for one year.

The High Council of Justice also noted that five years ago, Andriy Triska had already faced disciplinary action. At that time, he was suspended from judicial duties for three months, stripped of his bonuses, and sent to the National School of Judges for training.

According to a response from Lilia Yakimyak, deputy head of the Secretariat of the High Council of Justice, to a related journalistic inquiry, no specific timeline has been provided for the completion of the review of the disciplinary complaint against Volodymyr Yaroslavovych Marmash, a judge of the Lychakiv District Court of Lviv. Such a prolonged delay in reviewing the complaint may be a demonstration of collusion and a reluctance to hold accountable a “convenient” judge who willingly carries out tasks assigned by unscrupulous law enforcement officials.

The complaint against Marmash is that he issued his ruling after the deadline for the pretrial investigation had already expired, thereby making it impossible to grant the relevant motion. The only lawful option in such a situation was to return the motion; however, Judge V.Y. Marmash failed to comply with the requirements of the law.
