The High Council of Justice continues to gather evidence of unlawful actions by Judge Volodymyr Marmash

The High Council of Justice continues to consider a disciplinary complaint against Volodymyr Yaroslavovych Marmash, a judge of the Lychakiv District Court of Lviv. 

This became known from the response of Lilia Yakimyak, deputy head of the Secretariat of the High Council of Justice, to a corresponding request. 

"As of the date of this response, the preliminary review of your disciplinary complaint (ref. No. C-2178/1/7-25 dated October 21, 2025) is ongoing, and no decision has been made," the document states.

It also notes that it is currently unknown when a decision regarding the judge’s unlawful actions will be issued.

What the complaint is about


As previously reported, the High Council of Justice is currently considering a disciplinary complaint filed on behalf of Aliona Volodymyrivna Shevtsova against Judge Volodymyr Yaroslavovych Marmash of the Lychakiv District Court of Lviv, who committed gross violations bordering on disciplinary and criminal liability, in particular, considering the request of the BEB detectives to conduct a special pre-trial investigation against A.V. Shevtsova.

Judge Marmash V.Y. considered this motion significantly later, after the pre-trial investigation deadlines had expired, which made it impossible to grant the motion. The only lawful option in such a situation was to return the motion; however, Judge Marmash V.Y. failed to comply with the requirements of the law.

Subsequently, the Holosiivskyi District Court of Kyiv and the Kyiv Court of Appeals confirmed the validity of the conclusion that the time limits for the pre-trial investigation had expired as early as November 2024. At the same time, the motion for a special pre-trial investigation was considered in January-March 2025, i.e., outside the established procedural deadlines.

After the complaint against Marmash's actions was filed, the High Council of Justice did not inform the applicants about the progress and results of its consideration for a long time.

Recently, the editorial office received additional information on this case. Specifically, according to the body conducting disciplinary proceedings against Judge Marmash V.Y., the complaint filed on behalf of Shevtsova A.V. was not designated as a priority by disciplinary inspector Kabants O.O. and will be considered in chronological order based on the date of receipt.

What the law says


We remind you that pursuant to paragraph 4 of Part 1 of Article 43 of the Law “On the High Council of Justice,” the disciplinary inspector of the High Council of Justice shall, within thirty days from the date of receipt of such a complaint, prepare materials with a proposal to open or to refuse to open a disciplinary case. This period may be extended by the disciplinary inspector, but in the event of a justified need for additional verification of the disciplinary complaint, for no more than fifteen days. The

maximum possible period for preliminary verification ended on December 5, 2025. And this is only a matter of preliminary preparation. The consideration of the complaint itself, in the absence of exceptional circumstances, cannot exceed 90 days, which also expired on March 4, 2026. Such a prolonged delay in considering the complaint against V.Y. Marmash may be a demonstration of collusion and an unwillingness to hold accountable a “convenient” judge who willingly carries out tasks assigned by unscrupulous law enforcement officials.

As for Marmash V.Y. himself, in the event of a proper and fair review of the complaint, he is quite likely to first be removed from his position as a judge for breach of oath, and subsequently, it is only a matter of time before the former judge demonstrates on his own skin the inevitability of criminal liability for crimes against justice.
