Protasiv Yar has been definitively protected from development by the Supreme Court

The Supreme Court has put an end to the legal disputes over the environmental protection status of Protasov Yar in Kyiv. Ukraine’s highest court dismissed the lawsuit filed by the private company “Enso Group,” which sought to partially overturn the Kyiv City Council’s decision to establish a landscape reserve of local significance.

The Specialized Environmental Prosecutor’s Office of the Prosecutor General’s Office and the civic organization “Protect Protasiv Yar” defended the legality of the reserve’s creation in court. After the courts of first and appellate instance dismissed the lawsuit, the developer filed a motion to withdraw its claims before the cassation appeal was heard, leading to the final closure of the case.

The decision to establish the landscape nature reserve was adopted by the Kyiv City Council in July 2022—one month after the death on the front lines of Roman Ratushny, an activist and leader of the “Protect Protasiv Yar” organization. From now on, the nature conservation status of this unique green area in the center of the capital remains in effect and is not subject to further appeal.

As a reminder, the Court of Appeals had previously allowed development of the “Protasiv Yar” nature reserve in Kyiv.

Earlier, at a session of the Kyiv City Council, a draft resolution initiated by Mayor Klitschko regarding the purchase of land plots within the “Protasiv Yar” landscape reserve from the developer was considered.
