Attorney Shevchuk has withdrawn his request to resign from the SAP Commission and is asking Kovalsky to rescind Kravchenko's order
Attorney Oleksiy Shevchuk addressed the newly appointed acting headAnton Kovalsky with a request to withdraw his previous statement regarding the voluntary termination of his powers as a member of the Selection Committee for the competition to fill the administrative position of deputy head of the Specialized Anti-Corruption Prosecutor’s Office.
As a reminder, on September 4, 2026, then-Prosecutor General Ruslan Kravchenko signed an order terminating Shevchuk’s powers as a member of the SAPO Competition Commission ahead of schedule. The basis for this was a decision by the commission adopted on September 1. Previously, Shevchuk himself had announced his voluntary resignation.
Now the attorney states that he is withdrawing his resignation and considers the order terminating his appointment to have been issued in violation of the law.
“Taking into account the numerous substantial violations committed during the issuance by Prosecutor General Kravchenko of the order terminating my powers as a member of the Commission for the Competition to Fill the Administrative Position of Deputy Head of the Specialized Anti-Corruption Prosecutor’s Office, I hereby officially withdraw the statement I previously submitted to Prosecutor General Kravchenko regarding the voluntary termination of my powers as a member of the Commission,” the statement reads.
According to Shevchuk, Kravchenko’s order dated September 4 was issued without proper factual and legal grounds.
“My statement regarding the voluntary termination of my powers was, in and of itself, sufficient grounds for resolving the matter. Instead, the order was based on a decision by the Commission, the final text of which did not exist at the time of the vote on September 1, 2026, and which had not been finalized even by the date the order was issued—September 4, 2026,” the attorney asserts.
He also emphasizes that he was given until September 9 to file objections to the Commission’s decision; however, he says he has still not received the final text of that decision.
“As of today, I have not been provided with the final text of the relevant decision, and as a result, I was objectively deprived of the opportunity to properly formulate and submit my objections,” Shevchuk notes.
In his view, the order terminating his powers was issued even before the commission’s decision had been formally finalized and before he had exercised his right to file objections.
Separately, the attorney raised the issue of the selection committee’s authority following his resignation from the committee.
“After I submitted my application for voluntary termination of my powers, the question arose regarding the commission’s authority with an incomplete membership and, accordingly, its ability to continue the procedure for my dismissal,” he wrote.
In this regard, Shevchuk asks Kovalsky to review the grounds for Kravchenko’s order and to revoke it.
Among other things, he requests that he be provided with the full final text of the commission’s decision, which was considered on September 1, as well as documents confirming its adoption and finalization.
The attorney also requests that he be given the opportunity to submit written objections and have them included in the commission’s case file.
“Until these procedures are completed, please refrain from taking any actions based on the assumption that my powers as a member of the Commission have been definitively and indisputably terminated,” Shevchuk requests.
He separately emphasized that he is withdrawing his previous statement regarding the voluntary termination of his powers.
“I officially state: with this statement, I am withdrawing my previous statement regarding the voluntary termination of my powers as a member of the Commission,” the statement reads.
Shevchuk also stated his intention to continue performing his duties as a member of the Commission until the matter is finally resolved.
“I consider it necessary to continue fulfilling my duties as a member of the Commission until the issue of my termination is properly and lawfully resolved,” the lawyer noted.
The statement is addressed to Anton Kovalsky, who was appointed acting Prosecutor General of Ukraine by a presidential decree on September 17. Prior to this, Kovalsky headed the Khmelnytskyi Regional Prosecutor’s Office.
Previously, the situation surrounding the composition of the SAPO selection commission had already become the subject of public debate. In particular, Transparency International Ukraine stated that the commission could continue its work with at least four members, while Shevchuk insisted that its authority was compromised when not fully staffed.
