A former Kyiv City Council member received a suspended sentence for a traffic accident
Yaryna Ar’ieva, a former member of the Kyiv City Council who was accused of causing a traffic accident while under the influence of drugs, resulting in serious consequences, received a suspended sentence.
This was reported by the Kyiv City Prosecutor’s Office in a statement to Ukrainska Pravda.
The prosecutor’s office believes that the driver caused the accident while under the influence of drugs. This conclusion is based on an examination by a narcologist following the accident and the results of a toxicological analysis, which detected cannabis metabolites in the woman’s system.
The prosecutor asked the court to sentence Arieva to six years and six months in prison, with a ban on driving for eight years.
The court found the woman guilty of causing the traffic accident, but reclassified her actions from a violation of traffic rules while under the influence of drugs (Part 2 of Article 286-1 of the Criminal Code of Ukraine) to a violation of traffic rules without being under the influence (Part 2 of Article 286 of the Criminal Code of Ukraine).
Arieva was sentenced to five years in prison with a three-year ban on driving. Pursuant to Article 75 of the Criminal Code of Ukraine, the woman was released from serving her sentence with a three-year probationary period.
The prosecutor’s office disagrees with the court’s decision and will appeal it.
