TCCs are not authorized to issue alerts during an air raid alarm
TCK service members have no legal grounds to conduct public alert operations during an air raid alert. This is how the Ministry of Defense interprets its response to an inquiry from the Verkhovna Rada’s Temporary Investigative Commission.
As noted in the Ministry of Defense’s response, the law does not provide for stopping, detaining, or holding Ukrainian citizens in public places, nor does it permit obstructing their movement to shelters during an air raid alert.
The chairman of the TSC, People’s Deputy Oleksiy Honcharenko, stated that the practice of conducting mobilization measures during air raid alerts is not only not provided for by law but may also pose a real danger to TSC military personnel and those subject to military service.
“Thanks to the Temporary Investigative Commission, we now have a clear answer—such practices are not provided for by law. And the Temporary Investigative Commission will continue to work to ensure that the actions of the Territorial Defense Forces do not endanger the lives of Ukrainian citizens,” Goncharenko noted.
