VRP fired judge Iryna Maleh on suspicion of selling decisions
On May 7, the Supreme Council of the Judiciary decided to dismiss the judge of the Western Appeal Economic Court, Iryna Malekh. On the basis of the provision of clause 3 of the sixth article 126 of the Constitution of Ukraine.
The decision was made based on the results of consideration of the submission of the Second Disciplinary Chamber of the VRP.
The Council came to the conclusion that there is a basis for bringing the judge to disciplinary responsibility and applying the strictest penalty - the presentation of the release from office.
The SRP noted that the Constitution of Ukraine provides for the possibility of dismissal of a judge in case of a significant disciplinary offense, gross or systematic neglect of official duties, which is incompatible with the status of a judge or indicates his unfitness for the position.
"The basis for the dismissal of a judge is the commission of a significant disciplinary offense, gross or systematic neglect of duties, which is incompatible with the status of a judge or has revealed his inadequacy of the position," says the constitutional norm, which the decision refers to.
The decision of the VRP is the next stage of the disciplinary proceedings by the judge and must be implemented in accordance with the established procedure.
Let us remind you that the Supreme Council of Justice is considering a disciplinary complaint in the interests of Shevtsova Alena Vladimirovna against the judge of the Lychakovsky district court of the city of Lviv Marmash Vladimir Yaroslavovych, who committed gross violations on the verge of disciplinary and criminal responsibility during, in particular, the consideration of the petition of detectives BE A.V.
The claim against Marmash is that he made his decision already after the expiration of the pre-trial investigation period, which made it impossible to satisfy the corresponding request. The only legal option in such a situation was to return the petition, however, judge Marmash V.Ya. did not comply with the requirements of the law.
