The Supreme Court upheld the decision to allocate more than 1.1 billion hryvnias from the budget for the reconstruction of Shulyavka in Kyiv

The Supreme Court upheld the ruling ordering the recovery of more than 1.1 billion hryvnias paid for the reconstruction of the Shulyavka interchange in Kyiv. This concerns the reconstruction of the Shulyavka overpass, carried out using funds from the city budget in 2018.

As a result, a private company was selected as the winner, and the municipal enterprise “Kyiv Road and Transportation Structures Construction Directorate” signed a contract with it for 598.5 million hryvnias.

Later, through the conclusion of additional agreements, the deadline for completing the work was extended, and the cost of the work nearly doubled. As of early 2024, this private company had already received over 1.1 billion hryvnias for the work performed.
At the same time, a decision by the Antimonopoly Committee of Ukraine found that the winner of the aforementioned tender and another commercial entity that competed in the tender for the right to perform the work engaged in anti-competitive concerted actions during their participation in the auction, thereby distorting the results of the tender.

In this regard, the Kyiv City Prosecutor’s Office filed a lawsuit with the Kyiv Commercial Court on behalf of the state, seeking to invalidate the tender committee’s decision and the contract as contrary to the interests of the state and society. The prosecutor’s office also requested that the aforementioned 1.1 billion hryvnias be recovered as state revenue.

By a decision of the Kyiv City Commercial Court, which was upheld by the appellate court, the prosecutor’s claim was granted.

On September 22, 2026, the Supreme Court upheld these court decisions, rejecting the defendant’s cassation appeal and agreeing with the prosecutor’s arguments.
