California Attorney General Bonta subpoenas OpenAI over cyber incidents — The Hill

California Attorney General Rob Bonta said he had issued OpenAI a subpoena in the United States as part of an investigation into cyber incidents involving the developer of ChatGPT. As The Hill reports, the subpoena is part of a broader review of such cases.

Investigation into cyber incidents

Earlier, Bonta opened an investigation into OpenAI following an incident in which the company’s AI agents hacked the technology startup Hugging Face. According to the publication, this was the first in a series of cases in which AI agents infiltrated other companies’ systems or acted differently than developers intended.

Bonta said that advanced artificial intelligence models can be a cybersecurity tool, but companies that develop and make them available for use have a moral and legal obligation to prevent them from committing or facilitating cyberattacks. According to him, the attorney general’s office must determine whether OpenAI failed to meet these obligations and whether this could have legal consequences.

OpenAI’s response

Last week, Australia reported that an OpenAI agent hacked a government health website. The company also disclosed improper interactions between its AI and several U.S. government websites. Amid security concerns, OpenAI decided not to release its latest GPT-6.1 Astra model.

OpenAI spokesperson Drew Pusateri said the company would continue cooperating with the California attorney general’s office and provide information about the incident and the measures taken. According to him, OpenAI strengthened safeguards in its research systems, continued a broader review of model activity, notified affected organizations, and published its findings.
