The Rada did not support the bill to strengthen traffic enforcement due to a lack of a unified position
The Verkhovna Rada did not pass a bill to increase penalties for violations that can lead to injuries and fatalities on the roads. It fell one vote short of passing.
Legislative Initiative No. 15348 was supported by 225 members of parliament out of the 226 required.
The bill proposed adding an article to the Code of Administrative Offenses that would specifically address violations related to exceeding established speed limits for vehicles.
This article established the following penalty tiers for exceeding established speed limits for vehicles:
- 1) by more than 20 km/h – a fine of 680 UAH (40 non-taxable minimum incomes);
- 2) more than 40 km/h over the limit—a fine of 2,040 UAH (120 non-taxable minimum incomes);
- 3) more than 60 km/h over the limit—a fine of 2,720 UAH (160 non-taxable minimum incomes);
- 4) more than 80 km/h over the limit – a fine of 3,400 UAH (200 non-taxable minimum incomes);
- 5) Exceeding the speed limits specified in paragraphs three or four of this article by a person who has been subject to administrative penalties five or more times within a year for committing any violation specified in paragraphs three or four of this article, – 17,000 UAH (1,000 non-taxable minimum incomes).
The bill also specifies who will be considered the perpetrator of such an offense. If the violation was directly observed, it is the driver who was operating the vehicle at the time of the violation. If the speeding violation was recorded by an automated system, the responsible person is the individual identified in accordance with the Code, or the person who imported the vehicle, registered abroad, into Ukraine. At the same time, in cases provided for by the Code, the driver who was actually operating the vehicle at the time of the automatically recorded violation may be held liable.
A separate proposal was made to amend the rules for paying fines. For speeding by more than 20 km/h and more than 40 km/h, it was proposed to retain the option to pay 50% of the fine within 10 days of the date the citation was served. In such a case, the citation would be considered paid.
At the same time, for more serious speeding violations—exceeding the speed limit by more than 60 km/h or more than 80 km/h, as well as for repeat offenses—this option was not provided for.
It was expected that the adoption of the bill would help improve the safety of road users and provide a legal basis for holding individuals accountable for committing traffic safety violations, in particular those involving exceeding established speed limits for vehicles, and would consequently reduce the number of traffic accidents as well as the rate of fatalities and injuries on the road.
As a reminder, the Rada has increased penalties for fraud committed through call centers.
At the same time, the Rada rejected a bill to increase penalties for fatal traffic accidents.
In addition, the Rada allowed internally displaced persons from the temporarily occupied territories to purchase housing using vouchers and loans.
