A court revoked the registration of more than 1 hectare of land on the grounds of the Dovzhenko Film Studio
Following a lawsuit filed by the Shevchenkivskyi District Prosecutor’s Office of Kyiv, the court revoked the state registration of ownership rights to nonexistent buildings. The state registration of a land plot measuring more than 1 hectare was also revoked.
The land is located on the territory of the State Enterprise “Oleksandr Dovzhenko National Film Studio” and is part of its territory. The court’s decision prevented the possible transfer of this land plot out of state ownership.
Prosecutors determined that in 2018, an individual had registered ownership rights to two non-residential buildings with a total area of 162 square meters, allegedly located on this territory. Subsequently, these buildings were contributed to the authorized capital of a private company, and in 2019, ownership of them was registered in the company’s name.
At the same time, it was established that the buildings in question do not actually exist on the land plot. No permits were issued for their construction or commissioning, and ownership of this property was not registered.
Despite this, based on the registered ownership of nonexistent real estate, the company commissioned the development of a land-use planning project, after which, in 2022, a land plot with an area of 1.033 hectares was registered in the State Land Cadastre. Such actions indicate the company’s intention, as the owner of the “real estate,” to subsequently acquire this land parcel for ownership or use on non-competitive terms.
The court agreed with the prosecution’s arguments and granted the claim in full, revoking the state registration of ownership rights to the nonexistent buildings and the state registration of the land plot. In this way, the prosecutor’s office prevented the possible transfer of the land plot out of state ownership.
This was reported by the Kyiv City Prosecutor’s Office.
