The court ordered the company to refund 240 million hryvnias for defective infant incubators
The Northern Commercial Court of Appeals has upheld the legality of the recovery of over 240 million hryvnias from a commercial entity that supplied substandard medical equipment.
This was reported by the Office of the Prosecutor General.
The case involves transport incubators for infants that proved unsuitable for their intended use.
The dispute began after the state-owned enterprise “Ukrmedpostach” purchased 85 units of specialized equipment.
A foreign loan of 5 million euros, backed by state guarantees, was secured to finance this project.
After receiving the shipment, technical specialists conducted a thorough inspection of the equipment.
“After delivery, it was determined that the incubators had technical defects and could not be used in medical facilities for their intended purpose,” stated representatives of the prosecution.
Due to the critical defects identified, the prosecutor’s office initiated legal proceedings to recover state funds.
In August 2025, the Kyiv Commercial Court fully upheld the claims and ruled to recover the full amount from the supplier.
The defendant company disagreed with this verdict and filed an appeal, attempting to avoid financial liability.
However, the panel of judges of the Northern Commercial Court of Appeal carefully reviewed the case materials and the prosecutor’s arguments.
The appellate court upheld the prosecutor’s position regarding the breach of contract terms and the poor quality of the products.
The decision of the court of first instance was upheld, meaning it immediately became legally binding and enforceable.
