European Commission launches consultation on MiCA — Cyprus Mail

In Cyprus, the European Commission has launched a targeted consultation on whether EU rules for crypto-assets remain relevant amid market developments and the more active participation of traditional financial institutions. The discussion concerns the Markets in Crypto-Assets Regulation (MiCA), which began to apply partially on 30 June 2024 and in full on 30 December 2024.

The deadline for submitting responses through the official online questionnaire, specified in the consultation document, ended on 31 August 2026. As Cyprus Mail reports, only responses submitted through this questionnaire will be taken into account in the final report. The feedback received is intended to help determine whether changes to the regulatory framework are needed.

What the Commission will examine

The consultation is not a legislative proposal. The European Commission stressed that the document reflects the current approach of its services, rather than a final political position or a formal proposal. The responses will be used for possible further proposals and for the formal review of MiCA provided for by the regulation itself.

The Commission plans to compare MiCA with newer regulatory approaches in other jurisdictions and changes in the crypto market. This includes, in particular, the development of distributed ledger technologies, asset tokenisation and decentralised financial services. It also wants to find out whether the current rules create an excessive administrative burden for companies and regulators.

Tokens and crypto-services

Separate parts of the questionnaire are devoted to the scope of MiCA, rules for the public offering of crypto-assets and their admission to trading. The European Commission is also collecting views on asset-referenced tokens and e-money tokens, the requirements for their issuers and reserves, and holders' right to redeem tokens.

Another section concerns crypto-asset service providers and whether the list of services regulated by MiCA is sufficient. At the same time, supervision of such companies is not part of this consultation, as it is being considered within the markets integration and supervision package. The questionnaire also covers areas not included in the original version of MiCA: decentralised finance, staking, crypto lending, borrowing and non-fungible tokens.
